O paciente que desiste da vida, preferindo morrer a se submeter à cirurgia, tem a sua autonomia da vontade reconhecida na Resolução 1.995/2012 do Conselho Federal de Medicina. Esta manifestação, chamada pela norma de Testamento Vital, diz que não se justifica prolongar um sofrimento desnecessário em detrimento da qualidade de vida do ser humano.

 

O entendimento levou a 1ª Câmara Cível do Tribunal de Justiça do Rio Grande do Sul a confirmar decisão que garantiu a um idoso o direito de não se submeter à amputação do pé esquerdo, que viria a salvar sua vida. Assim como o juízo de origem, o colegiado entendeu que o estado não pode proceder contra a vontade do paciente, como pediu o Ministério Público, mesmo com o propósito de salvar sua vida.

 

Além da Resolução do CFM, o relator da Apelação, desembargador Irineu Mariani, afirmou no acórdão que o direito de morrer com dignidade e sem a interferência da ciência (conhecida como ortotanásia) tem previsão constitucional e infraconstitucional.

 

Pois bem, o direito à vida, garantido pelo artigo 5º, caput, deve ser combinado com o princípio da dignidade humana, previsto no artigo 2º, inciso III, ambos da Constituição Federal. Isto é, vida com dignidade ou razoável qualidade. Entretanto, em relação ao seu titular, o direito à vida não é absoluto, pois não existe obrigação constitucional de viver. Afinal, nem mesmo o Código Penal criminaliza a tentativa de suicídio.

 

No âmbito infraconstitucional, podemos citar as disposições do artigo 15 de Código Civil: “Ninguém pode ser constrangido a submeter-se, com risco de vida, a tratamento médico ou a intervenção cirúrgica’’.

 

Nessa ordem de ideias, a Constituição institui o direito à vida, não o dever à vida, razão pela qual não se admite que o paciente seja obrigado a se submeter à cirurgia ou tratamento, além do que, no caso específico da decisão mencionada, deve se considerar que o trauma da amputação pode causar sofrimento moral.

 

Portanto, sendo o paciente pessoa capaz, tendo livre escolha para agir e, provavelmente, consciência de eventuais consequências, não cabe ao Estado interferir na sua vontade de viver ou morrer.
